Terms and Conditions

These Terms govern your use of all services at Fittopia Wellness Studio, including AXIS Reformer classes, private Pilates, physiotherapy, and memberships. Please read carefully before booking or participating.

1. Introduction

These Terms and Conditions of Service (the "Agreement" or "Terms") constitute a binding legal agreement between you ("you" or "your") and 1508814 B.C. LTD., operating as Fittopia Wellness Studio, a subsidiary of Fittopia Fitness Centre Ltd. ("Fittopia," "we," "our," or "us").

These Terms govern your access to and use of all services, programs, facilities, online systems, and physical locations offered by Fittopia Wellness Studio, including physiotherapy sessions, Pilates classes, private training, online coaching, wellness workshops, and use of fitness and rehabilitation facilities (collectively, the "Services").

By accessing, purchasing, reserving, booking, registering for, or otherwise engaging in any Services, whether in person at 122-4940 No. 3 Rd, Richmond, BC, via www.fittopia.ca/studio, affiliated apps, or any other Studio platform, you agree to be bound by these Terms.

Selecting "I Agree," "Submit Order," "Register," or similar language constitutes your legal acknowledgment that you waive certain rights as described in this Agreement.

2. COVID-19 and Communicable Diseases

By entering the Studio or participating in in-person Services, you acknowledge and accept the risk of exposure to COVID-19 or other communicable illnesses.

Do not attend if you are experiencing symptoms, have tested positive for a contagious illness within the last 10 days, or are under any isolation or quarantine order. Fittopia reserves the right to deny entry to or remove any person exhibiting symptoms in order to protect all patrons and staff.

3. Waiver, Release, and Assumption of Risk

You understand and accept that wellness, exercise, and rehabilitation activities involve inherent risks, including but not limited to muscular injuries, strains, sprains, fractures, dislocations, cardiovascular complications, pregnancy-related complications, property damage, and, in rare cases, paralysis or death.

You voluntarily assume all risks associated with your participation in the Services, whether foreseeable or not, and whether arising from your own actions or those of others, including Fittopia staff or other participants.

You hereby release, waive, discharge, and relinquish any and all claims or causes of action for personal injury, property damage, or wrongful death that you may have, now or in the future, arising out of or related to your participation in Fittopia Services.

It is your express intention by this Agreement to exempt and relieve Fittopia Wellness Studio and all Released Parties from any liability for personal injury, property damage, or wrongful death caused by negligence, except where such damage is caused by the gross negligence or willful misconduct of Studio staff acting within the scope of their duties.

4. Medical Clearance and Health Disclosure

You affirm that you are physically and mentally fit to participate in the Services and that you have not been advised otherwise by a qualified medical professional.

You agree to disclose all relevant medical conditions prior to participation, including but not limited to recent surgeries, chronic conditions, pregnancy, cardiovascular conditions, and injuries. Fittopia may request physician clearance or deny access where warranted for health and safety reasons.

Fittopia staff are trained fitness and wellness professionals. They do not provide medical diagnoses or replace the advice of a physician.

5. Indemnification

In exchange for being permitted to participate in the Services, you irrevocably waive, release, and discharge Fittopia, its parents, subsidiaries, affiliates, and all directors, officers, employees, contractors, physiotherapists, instructors, and agents (the "Released Parties") from any and all claims arising from your participation, including those based on negligence, property loss, bodily injury, emotional harm, or death, except where caused by gross negligence or willful misconduct.

You agree to indemnify and hold harmless the Released Parties from any third-party claims, damages, costs, or expenses (including reasonable legal fees) arising out of your conduct, breach of these Terms, or misuse of Studio facilities or equipment.

6. Personal Property

Fittopia is not responsible or liable for any loss, theft, or damage to personal property brought onto Studio premises, including vehicles and their contents.

Any damage to Studio facilities or to another person's property caused by you or your guests is your sole responsibility. You may be required to reimburse Fittopia for the cost of repairs or replacements resulting from such damage.

7. Force Majeure

Fittopia shall not be liable for any delay or failure to perform its obligations under these Terms due to causes beyond its reasonable control, including but not limited to natural disasters, acts of war or terrorism, governmental restrictions, public health emergencies, utility failures, or internet outages.

In such circumstances, Fittopia will make reasonable efforts to reschedule affected services or provide appropriate credit where feasible.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the total aggregate liability of Fittopia and the Released Parties for any claims arising under or related to these Terms shall not exceed the greater of: (i) the total amount you paid to Fittopia in the six (6) months immediately preceding the event giving rise to the claim, or (ii) $500.00 CAD.

In no event shall Fittopia be liable for indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages.

9. Governing Law and Jurisdiction

These Terms are governed exclusively by the laws of the Province of British Columbia and the applicable federal laws of Canada. You consent to the exclusive jurisdiction of the courts of British Columbia for the resolution of any disputes arising under or related to these Terms.

10. Eligibility

You must be at least 16 years of age to access and use the Services. Participants between the ages of 16 and 18 require written parental or guardian consent (Minor Waiver) and either direct supervision by a parent or guardian, or written approval from Studio management.

By agreeing to these Terms, you represent that you meet the eligibility requirements described above.

11. Account Registration

You must register an account to book Services. You agree to provide accurate, complete, and current information at the time of registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify Fittopia immediately if you suspect unauthorized use of your account.

12. Code of Conduct

Fittopia maintains a zero-tolerance policy for disrespect, discrimination, harassment, bullying, and inappropriate behaviour of any kind toward staff, instructors, or other clients.

Violations of this policy may result in immediate removal from the premises and/or permanent termination of your access to Studio services, with or without refund, at the sole discretion of Studio management.

All clients are expected to arrive on time, follow instructor directions, and clean and return equipment after use. Repeated late arrivals or failure to follow Studio protocols may result in a warning or loss of booking privileges.

13. Subscription Billing

Fittopia Wellness Studio offers recurring membership plans billed monthly, bi-weekly, or annually depending on the plan selected. By enrolling in a membership, you authorize Fittopia or its designated payment processor to automatically charge your selected payment method on the applicable billing date.

Memberships auto-renew at the end of each billing cycle unless canceled in accordance with Section 15 of these Terms.

14. Payment Failures

If a scheduled payment fails, Fittopia may suspend your access to Services until full payment is received. A retry will be attempted within a reasonable period.

Repeated payment failures may result in the termination of your membership and Services. Outstanding balances must be resolved before new memberships or service packages can be activated.

15. Membership Cancellation

All memberships require a minimum commitment of two (2) full billing cycles (60 days) before cancellation is permitted. After completing the minimum term, you may cancel at any time by submitting written notice to studio@fittopia.ca at least fourteen (14) days before the end of your current billing cycle.

Your cancellation notice must include your full name, account email address, and reason for cancellation. Cancellations take effect on the final day of your current billing cycle, provided notice is received on time. Early termination fees may apply if you cancel within a fixed-term agreement.

For unlimited memberships: late class cancellations (less than 12 hours before class) or no-shows incur a $25 fee per occurrence.

Verbal, phone, and in-person cancellations are not accepted. All cancellations must be submitted in writing to studio@fittopia.ca.

16. Class and Session Cancellation Policy

Group classes must be canceled at least 12 hours before the scheduled start time to avoid penalties. Late cancellations and no-shows are subject to the following: credit pack and drop-in users will forfeit the credit for that session; unlimited membership holders will be charged a $25 late cancellation or no-show fee.

Private and semi-private training sessions require at least 12 hours notice for cancellation or rescheduling. Changes or cancellations made within 12 hours of the scheduled session will result in the deduction of one (1) full session from your package, or a charge equal to the single-session rate, at the Studio's discretion.

All cancellations must be made through your online account at www.fittopia.ca/studio. Cancellations by email, phone, or in person are not accepted.

17. AXIS Group Class Policy

Credit Expiry

AXIS class credits are valid from the date of purchase as follows: Single session: 1 month; Pre-Sale 4 Credits: 6 months; 6 Credits: 3 months; 12 Credits: 6 months; 16 Credits: 8 months. Credits are non-transferable and non-refundable. Expiry extensions may be considered only upon written request submitted before the expiry date, at the Studio's sole discretion.

Cancellations

Cancellations must be made at least 12 hours before the scheduled class start time through your Fittopia online account. Late cancellations and no-shows result in: credit forfeiture for credit pack or drop-in users; a $25 late cancellation or no-show fee for unlimited membership holders. Email, phone, and in-person cancellations are not accepted.

Studio Etiquette

Arrive on time and ready to participate. Follow all instructor directions without exception. Clean all equipment thoroughly after use. Repeated late cancellations, no-shows, or disruptive conduct may result in suspension of your booking privileges.

18. Private Pilates Training Policy

Refund Policy: BC Consumer Protection Rights

When purchasing a private Pilates session package, you receive a discounted per-session rate. Under the Business Practices and Consumer Protection Act, S.B.C. 2004, c.2, you have the right to request a refund within 10 days of purchase. If sessions have been used, the refund amount will be reduced by the full single-session price for each completed session, calculated as: Refund = Prepaid Amount − (Single-Session Price × Sessions Used). To cancel, provide written notice by registered mail to Fittopia Wellness Studio, 122-4940 No. 3 Rd, Richmond, BC, V6X 3A5, or by email to studio@fittopia.ca. If sent within the 10-day period, the cancellation is valid regardless of the date of receipt. Refunds will be processed within 15 days of cancellation.

Package Expiry

Prepaid private training session packages expire from the date of purchase as follows: Single sessions and promotional or introductory offers under 10 sessions: 1 month; 12 sessions: 3 months; 24 sessions: 6 months; 48 sessions: 12 months. Extension requests must be submitted at least 30 days before expiry to studio@fittopia.ca and may be granted at the Studio's sole discretion. Sessions remaining after expiry are forfeited.

Rescheduling and Late Cancellations

Changes or cancellations made within 12 hours of a scheduled private or semi-private session will result in the automatic deduction of one-half (1/2) session from your package to compensate the instructor for their reserved time.

19. Amendments to These Terms

Fittopia reserves the right to update or modify these Terms at any time. Material changes will be communicated via email to registered clients and posted on our website with an updated effective date.

Your continued use of the Services after the effective date of any amendments constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
